Abstract
AbstractThis chapter puts the relationship between judicial governance and democratic quality in context. Using modernization theory the chapter hypothesises that the negative correlation found earlier in this book between the existence of judicial councils and democratic quality is a result of an omitted variable bias: that omitted variable is modernization. Using robust regressions, the chapter shows that, in general, variations in the design of judicial governance have no significant effect on the quality of democracy in European countries.
