Abstract
This article updates the decisions made by public employee relation boards and the state courts in regard to the scope of bargaining in the public sector; specifically mandatory subjects of bargaining. The findings suggest that public employee relation boards and the state courts have expanded the scope of mandatory subjects of bargaining to include topics such as class size, drug testing, and smoking in the workplace. These topics were once typically considered management rights.
