Abstract
Abstract
This chapter covers the application of Agreement on Technical Barriers to Trade (TBT Agreement). TBT Agreement primarily focuses on technical regulations and other technical standards related to product characteristics or production processes. Technical rules are subject to the national treatment principle and the most-favoured-nation principle. Moreover, recognized international standards must be considered as guidelines and as standards of review for national regulations, even if they were established after a technical regulation. The chapter explains that technical regulations may not restrict international trade beyond the extent necessary to protect a legitimate interest.
