Assessing Criteria of Legal Regulation Effectiveness as a Legal Technology

Abstract

The article defines the concepts of «evaluation of legal regulation eff ectiveness» and «the evaluation criteria of the legal regulation eff ectiveness». These criteria are considered as the essential features refl ecting the goals and principles of legal regulation, on their basis legal regulation eff ectiveness is evaluated. Evaluation criteria of legal regulation eff ectiveness is a tool for determining the degree of achievement of the goal of legal regulation and is considered as a structural element (namely, the technique of the evaluation of the eff ectiveness) of such technology of law as the evaluation of legal regulation eff ectiveness. The criteria classifi cation of legal regulation eff ectiveness evaluation on various grounds is carried out. The position of impermissibility of borrowing criteria of the evaluation of legal regulation eff ectiveness from the economic sciences is defended. The peculiarities of law as a social regulator, its importance for maintaining stability in society in some cases require large human, material and fi nancial costs. In this regard, it is unacceptable to proceed only from the minimum cost criterion.
