On Methods for Identifying and Eliminating Defects in Normative Legal Acts

Abstract

The article analyzes the legal norms with the help of which the judicial authorities of the Russian Federation can identify defects in legislation and help to eliminate them. The conducted research has shown that modern procedural methods of carrying out judicial activity are not aimed at identifying defects in normative legal acts by the courts, as well as their elimination using various methods of interpretation. This is not least due to the Soviet legal traditions, a mandatory part of which was the unlimited freedom of the legislator. Despite the fundamental socio-economic and political changes in our country, the expansion of the control functions of the judiciary, such traditions continue to exist and are maintained.
