AbstractThe idea of minority rights is deeply contested in contemporary political theory. The core controversy arising from the development of such rights in both theory and practice is whether the moral, legal, and political existence of groups may be truly recognized within the individualistic framework ofhumanrights. The concern is that the modern human rights regime, with its characteristic liberal reluctance to impose fixed group identities on individuals, inevitably struggles to respond fully to minority conflicts today, which often involve tense relations within and between groups, rather than simply relations between the individual and the state.
