The Constitutional Prohibition Against Opening of Accounts with Foreign Banks: Consolidation, Content, Prospects

Abstract

This article analyzes the prohibition for public officials to open accounts in foreign banks located outside the territory of the Russian Federation. This ban was included in the text of the Constitution of the Russian Federation as a result of the constitutional reform in 2020. The Federal law on this ban was adopted in 2013, but the constitutional and legal scientific discussion on this issue has not yet developed. As the level of this problem increases to the constitutional level, Russian constitutional studies should be better able to navigate it. Therefore, the publication offers an analysis of the features of this prohibition in the updated Constitution of the Russian Federation and current legislation, discusses its place in the system of similar legal mechanisms, the specifics of its legal nature, as well as a number of interesting prospects for the development of scientific discussion.
