1. Footnote 5 of the GATS permits the Members to invoke "public order" as a ground only where "a genuine and sufficiently serious threat is posed to one of the fundamental interests of society" 92 . But like "public morals", here too previous Panels and the Appellate Body has provided Members with considerable leeway to define what constitutes as "public order" and whether it poses a threat to the fundamental interests of the society;the text is much stricter when it comes to invoking "public order" under Article XIV
