Abstract
The Condominiums’ Management Act (enacted in 2009, State Gazette, No. 6 of Jan. 23, 2009, effective May 1, 2009) governs a specific kind of residential complex, known as a "closed residential complex". These provisions (sometimes deficient and insufficient) present many practical problems. They concern the closed residential complex nature, the management of the shared areas, and the possible content of management contract clauses and registration. The present study discusses some of these legislative problems, emphasizing individual opinions on the legal doctrine and a case study of possible solutions.
