Abstract
Although lawsuits against mental health professionals are increasing, the responses by professionals generally have been well out of proportion to the nature of the risk. In some cases, a simple phobic pattern has been observed. Suggestions for coping with the fear of litigation include knowledge of baserates, use of consultation and training, and heightened awareness of defensive and unnecessary consequences.
