Compensation and Beyond

Abstract

Abstract This chapter argues that sometimes compensation is an appropriate response to the disadvantages created by appearance discrimination, both when it is morally permissible and when it is not. A practical and moral case is made for using a Dworkinian hypothetical insurance approach as a practical guide to the level and kinds of compensation that are justified, in effect treating being regarded as attractive as akin to possessing talents that are in high demand in the market. But the limitations of a strategy that seeks to prevent wrongful appearance discrimination from occurring, and then to provide compensation for those who are nevertheless disadvantaged by their appearance, are explored. The idea that the fundamental problem raised by appearance discrimination is that our societies place too much importance on appearance, and are governed by demanding, non-inclusive appearance norms, is endorsed in a qualified form and its implications considered.
