Development of the Concept of a Normative Legal Act in the Practice of the Constitutional Court of the Russian Federation

Abstract

The Constitution of the Russian Federation proceeds from the fact that the main activity of the Constitutional Court of the Russian Federation is judicial constitutional normative control, i.e. verification of the constitutionality of normative legal acts. In this regard, the question of the content of the concept of «normative legal act» in the framework of constitutional justice is of particular importance. The article notes that this issue was especially actively studied by the Constitutional Court at the first stage of its history (before the current Constitution came into force). The prerequisite for this was the general disorder of law-making activities in the country, together with the novelty of the institution of constitutional justice itself. At the same time, the Constitutional Court further continued the development of ideas about a normative legal act as the main object of constitutional control.
