Black's Law Dictionary (5th edition [1979 ]: p. 823 ) defines liability as "a broad legal term ... of the most comprehensive significance, including most every character of hazard or responsibility." Among the definitions assigned to the word "liability" are the "condition of being actually or potentially subject to an obligation" and the "condition of being responsible for a possible or actual loss, penalty, evil, expense, or burden." These definitions include civil, criminal, regulatory, or other types of Liability. This article will focus exclusively on the type of liability that increases insurance rates, namely liability for negligence, or malpractice.
