Odgovornost za štetu nastalu upotrebom automatizovanog vozila

Abstract

Advanced technology enables driverless vehicles powered by artificial intelligence (AI) to appear in the near future. The paper analyzes the need to improve the legal regulations on liability for damage from the use of partially and full automated (autonomous) vehicles. Based on good examples from foreign laws and recent EU laws, the author believes that the strict liability of manufacturers for robotic cars should be regulated in Serbian law. Moreover, the liability should move from the driver and/or the car owner to the vehicle manufacturer (including the software design company and company operating the software). In order to protect victims of traffic accidents, compulsory auto insurance should be prescripted as well as the insurance of the manufacturer's liability based on the risk of damage caused by AI. Just exceptional damages caused by a cyber attack on AI (hacking) should be compensated under restrictive conditions from a special fund.
